Plumbing Contractor Software Terms of Service
Operator: Yassine Rajallah (operating as Plumbing Contractor Software) Last Updated: 21st October 2026 Version: 1.1
1. Parties and Agreement
1.1 These Terms of Service (“Terms”) govern your use of the website plumbingcontractorsoftware.com, including its articles, statistics pages, tables, sample quotes and prices, and any calculator or tool on it, and the emails you exchange with us about it (together, the “Service”). The Service is operated by Yassine Rajallah, a sole proprietor under German law, Berlin, Germany, operating as Plumbing Contractor Software (“we”, “us”).
1.2 These Terms are General Terms and Conditions (Allgemeine Geschäftsbedingungen, “AGB”) within the meaning of §§ 305 et seq. of the German Civil Code (Bürgerliches Gesetzbuch, “BGB”).
1.3 By using the Service you accept these Terms. If you do not agree, do not use the Service.
1.4 The Service is intended for businesses and tradespeople (Unternehmer within the meaning of § 14 BGB) and is not directed at persons under 18. If mandatory law grants you rights as a consumer (Verbraucher, § 13 BGB), those rights are not affected by these Terms.
1.5 Where you use the Service on behalf of a company or other entity, you confirm that you are authorised to bind it to these Terms. In that case, “you” means that entity.
1.6 Your own general terms and conditions do not apply, even if we do not expressly object to them. An individual agreement made with us in writing or text form takes precedence over these Terms.
2. Description of the Service and Pre-Release Status
2.1 The website describes software for plumbing shops: a price book, quotes, invoices and related tools. That software is not released yet. Nothing on the site is an offer to sell it, and no price has been set.
2.2 We do not promise that the software will be released, when it will be released, or on what features, plans, prices or terms. Descriptions of the software and of planned tools on the site describe plans. They are not a promise and not an agreed quality (Beschaffenheitsvereinbarung) of anything, and the software may be different, delayed, limited to some regions or never released. You should not make business decisions in reliance on them.
2.3 You can ask for early access by email. Asking creates no contract and no right to receive the software, a place on any list, a discount or a price. Being on the early access list does not oblige you to anything either. When the software is released, it will come with its own terms and plan, which you will see before you start, and these Terms will be updated before it opens.
2.4 The website, its information and its tools are free of charge. We may change, pause, limit or stop the Service, or the plans for the software, at any time and without giving a reason. There is no entitlement to the availability of the Service.
2.5 We aim to keep the website available but do not guarantee uninterrupted operation, and there is no agreed service level. Outages caused by hosting, network, domain name, email or device providers, or by your own systems, are not our responsibility. We may use subcontractors and third-party providers to run the Service.
3. Information, Statistics and Calculators (No Advice)
3.1 Everything on the site, including articles, statistics pages, charts, sample quotes, sample prices, descriptions of tools and any calculator, is general information. It is not plumbing, engineering, legal, code-compliance, tax, accounting, insurance, financial or business advice, and it does not create an advisory or professional relationship between you and us. Sample prices are examples only and are not a recommendation, a market price or advice.
3.2 Statistics and figures on the site are collected from third-party sources, such as government agencies, trade bodies, companies and studies, which we name where we use them. Such figures can be wrong, incomplete, estimated, out of date, based on a different country, trade or definition than yours, or revised by their source after we published them. We do not check them beyond reasonable care, and we do not guarantee that they are accurate, complete or current. Check the original source before you rely on a figure.
3.3 Calculators, tables and tools are aids. They do not replace the adopted plumbing code, the local authority, the manufacturer’s instructions, a licensed professional or an inspector. Check your local code and your product’s data before you design, price or build anything, and have safety-relevant work done and checked by a licensed professional. We do not claim that any result meets a code or is approved by anyone.
3.4 We do not guarantee any result from the use of the Service or of the software, including savings, profit, time saved, win rates, prices achieved, inspection outcomes or business success.
3.5 You are solely responsible for the prices you quote, the work you do, the code and safety compliance of that work and the agreements you make with your customers.
4. Amendments to These Terms
4.1 We may amend these Terms for valid reasons, in particular changes in law or case law, changes in the technical environment, changes by third-party providers on which the Service depends, changes to our business or the Service, or the release of the software. The current version is always at plumbingcontractorsoftware.com/terms-of-service/ with the “Last Updated” date at the top. For the website, its information and its tools, which you use one visit at a time, the version in force on the day you use them applies.
4.2 Where a continuing contract exists between you and us (for example an account once the software is released), we will send you the amended Terms by email at least 30 days before they take effect. If you do not object in text form before that date, the amended Terms are deemed accepted. If you object, either party may end the contract with effect from the date the amendment would have taken effect. We will point out this right to object and the consequence of silence in the notice.
4.3 Amendments that are exclusively beneficial to you or that are required by law may take effect without the notice period.
5. Acceptable Use
You may not:
5.1 Attempt to disrupt, overload or gain unauthorised access to the website, its hosting, our visit-counter server or our email;
5.2 Use the Service for any unlawful purpose, or to infringe the rights of others;
5.3 Remove or alter copyright notices, or present the Service or its content as your own product;
5.4 Copy, republish, resell or sublicense the Service or its content beyond what is allowed in Section 6, or reverse engineer it or build a competing product from it, except where the law allows it despite this clause;
5.5 Use bots, scrapers or other automated means to access the Service in a way that burdens it, or circumvent security, access control or rate limits;
5.6 Misrepresent your identity, your affiliation with us or your authorisation, or imply that we endorse you, your business or your products;
5.7 Send us unlawful, abusive, deceptive or harmful content or malicious code, including by email.
If you breach this Section, we may block your access to the Service, remove content you sent us and, where the law allows, claim damages.
6. Intellectual Property
6.1 The texts, statistics compilations, charts, tables, tools, design, software, trademarks and images of the Service belong to us or to our licensors, and are protected by German and international intellectual property law. You may read the Service and share links to it. Any other use, such as copying, republishing or commercial reuse, needs our written permission, except where mandatory law (including statutory quotation rights) allows it. We grant no other licence. Where we quote or show data from third parties, their rights remain with them.
6.2 Anything you send us, such as a message, correction or suggestion, you may send freely. You give us a simple, worldwide, royalty-free right to use it to run and improve the Service without paying you, and you promise that you have the right to send it and that it does not infringe the rights of others. We do not have to use it, and we do not take on any duty of confidentiality for it unless we agree so in writing.
7. Third Parties
7.1 Product and company names mentioned on the site, including ServiceTitan, Housecall Pro, Jobber, Intuit and QuickBooks, belong to their owners. We are not affiliated with them, and mentioning them is not an endorsement.
7.2 Links, sources and email addresses on the site may lead to services or content run by others. We do not control them and are not responsible for their content, availability or accuracy.
8. Disclaimer of Warranties
8.1 The Service is provided free of charge and in the state in which it is available at the time of use.
8.2 To the extent the law allows, we do not warrant that the Service is error-free or uninterrupted, that information, statistics, sample numbers or calculator results are accurate, complete, current, original or suit your business, your costs, your market, your building or your jurisdiction, or that any particular result will be achieved. Check every number before you rely on it.
8.3 Statements on the site are not agreed quality. Sample quotes, screenshots, examples and descriptions of the software illustrate how it is meant to work and are not a promise that it will work like that.
8.4 Mandatory statutory rights, including those of consumers, are not affected by this Section.
9. Limitation of Liability
9.1 Unlimited liability: We are liable without limitation for damages arising from (a) intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit) of us, our legal representatives or our agents, (b) injury to life, body or health, (c) fraudulently concealed defects (§ 524 BGB), (d) a guarantee (Garantie) that we have expressly given in writing and designated as such, and (e) mandatory liability under applicable law, including the German Product Liability Act (Produkthaftungsgesetz) and Art. 82 GDPR.
9.2 Free parts of the Service: Because the website, its information, its statistics and its tools are provided free of charge, we are liable for them only in the cases of Section 9.1.
9.3 Slight negligence: For anything else, in cases of slight negligence (einfache Fahrlässigkeit) we are liable only for breach of an essential contractual obligation (Kardinalpflicht), meaning one whose fulfilment makes the proper use of the Service possible in the first place and on which you may regularly rely. In that case our liability is limited to the damage that is typical for this kind of contract and was foreseeable when it was concluded. Given that nothing is charged for the Service, the parties agree that this typical, foreseeable damage does not exceed EUR 300 per calendar year. In all other cases of slight negligence, our liability is excluded.
9.4 What we do not answer for. Within the limits of Sections 9.1 to 9.3, we are not liable for the prices you set, the work you do, disputes between you and your customers, code, safety or inspection outcomes, decisions you take on the basis of information, statistics or calculator results, the plans for the software not being carried out, lost profit that is not typical and foreseeable, loss of data, the acts or failures of third parties such as hosting, network, email and device providers, or events outside our control.
9.5 Contributory fault. If damage is also caused by your failure to check information against the original source, the local code or a licensed professional, or to follow our reasonable instructions, § 254 BGB applies.
9.6 Time limit. Claims against us expire one year after the claim arises and you know or should know of the circumstances. This does not apply to the cases in Section 9.1.
9.7 The limitations in this Section also apply in favour of our employees, agents, vicarious agents and sub-contractors, and do not change the burden of proof. Nothing in this Section limits statutory rights that cannot be limited, including those of consumers.
10. Indemnification (Business Users Only)
10.1 If you use the Service as a business (Unternehmer), you will indemnify us against claims by third parties, including customers, authorities and rights holders, and against the reasonable costs of legal defence (including lawyers’ fees at statutory rates), to the extent these arise from (a) your breach of these Terms or of the law, (b) content you send us or publish using material from the Service in a way these Terms do not allow, or (c) your work, your quotes and your agreements with your customers, including any claim that work did not meet a code, a standard or a safety requirement because you relied on information, statistics or calculator results from the Service.
10.2 This does not apply if you are not responsible for the underlying breach or event, and it does not apply to consumers. We will inform you without delay of any claim, will not acknowledge it without your consent, and will give you the opportunity to take part in the defence. Our liability under Section 9 is not extended by this Section.
11. Data Protection
Our processing of personal data is described in the Privacy Policy, which forms part of these Terms. It also explains the cookie banner and how to change your cookie choice at any time with the “Cookie settings” button in the footer.
12. Termination and Suspension
12.1 You may stop using the Service at any time. To be removed from the early access list, write “Remove me” to hello@plumbingcontractorsoftware.com.
12.2 We may block or limit access to the Service, or end the Service or any part of it, at any time. If there are specific indications that you are breaching these Terms or the law, or if a block is needed to protect the Service or third parties, we may do so immediately and without notice. Each party’s right to end a continuing contract for good cause (aus wichtigem Grund) remains unaffected.
12.3 When your use ends, your permission to use the Service ends. Sections 3, 5, 6, 8, 9, 10, 13 and 14 continue to apply, as does the Privacy Policy for data we still hold.
13. Dispute Resolution and Governing Law
13.1 Before starting any formal proceedings, please contact us at hello@plumbingcontractorsoftware.com. We aim to respond within 14 days.
13.2 We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).
13.3 These Terms and any contract concluded under them are governed by the laws of the Federal Republic of Germany, excluding its conflict of law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection rules of your country of residence remain unaffected.
13.4 If you are a merchant (Kaufmann), a legal entity under public law or a special fund under public law, or if you have no general place of jurisdiction in Germany, the exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is Berlin, Germany. We may also bring proceedings at your general place of jurisdiction. For consumers, the statutory rules on jurisdiction apply.
14. Miscellaneous
14.1 Severability: If any provision of these Terms is or becomes void or unenforceable, the statutory provision applies in its place (§ 306(2) BGB). The remaining Terms stay in force. A void provision does not make the whole contract void.
14.2 Entire agreement: These Terms, the Privacy Policy and any individual written agreement with us are the whole agreement between you and us about the Service. There are no verbal side agreements.
14.3 No waiver: If we do not enforce a provision on one occasion, that does not waive our right to enforce it later.
14.4 Assignment: We may transfer our rights and obligations under these Terms to a successor who continues the Plumbing Contractor Software business, and we will tell you in advance. You may not assign your rights under these Terms without our consent in text form.
14.5 Force majeure: Neither party is liable for delay or failure caused by circumstances beyond its reasonable control, including natural disasters, war, pandemics, government measures, strikes, failures of telecommunications networks, and outages or policy changes of third-party providers such as hosting, domain name, email and network providers.
14.6 Notices: Notices to us must be given in text form (for example by email) to hello@plumbingcontractorsoftware.com. Notices to you may be given to the email address you wrote to us from, or on the website.
14.7 Language: These Terms are provided in English. If a translation exists, the English version prevails.
